Terms & Conditions

1. General terms

1.1 By booking a tour with Key2MIA®, you (the “Participant”) agree to be bound by these Terms and Conditions.
1.2 These Terms and Conditions apply to all tours, events, and services provided by Key2MIA®.
1.3 Participants must be at least 18 years of age or have the consent of a legal guardian to participate.
1.4 Key2MIA® reserves the right to modify or cancel any tour due to unforeseen circumstances, including weather, safety concerns, or low participation.

2. Payment & cancellation policy

2.1 Full payment is required at the time of booking to confirm your reservation unless otherwise stated.
2.2 Cancellations made 72 hours or more before the scheduled tour date will receive a full refund. Cancellations made within 72 hours of the tour will not be refunded.
2.3 No-shows or late arrivals will not receive a refund.

3. Group size

3.1 Private tours require a minimum of 10 participants and accommodate up to 75 participants.
3.2 If the minimum group size is not met, Key2MIA® reserves the right to cancel or reschedule the tour.

4. Health & safety

4.1 Participants are responsible for ensuring their physical fitness to participate in the tour.
4.2 Key2MIA® is not responsible for any pre-existing health conditions that may be aggravated by tour activities.
4.3 Participants must follow all safety instructions provided by the tour guide or staff.

5. Behavior & conduct

5.1 Participants are expected to behave respectfully towards others, including fellow participants, staff, and community members encountered during the tour.
5.2 Key2MIA® reserves the right to remove any participant from the tour without a refund if their behavior is disruptive or endangers the safety or enjoyment of others.

6. Waiver & release of liability

By reserving, purchasing, or participating in a tour, you (the Participant) agree to the following:

6.1 Acknowledgment of Risk: I acknowledge and fully understand that the tour involves inherent risks, including but not limited to physical exertion, unpredictable weather conditions, uneven terrain, and other unforeseen events. I voluntarily assume all risks associated with my participation.

6.2 Release of Liability: I hereby waive any and all claims I may have now or in the future, and release from all liability, Key2MIA®, its officers, agents, representatives, employees, tour guides, and partners (including but not limited to Revel Transit Inc.), for any injury, death, property damage, or loss sustained as a result of my participation in the tour, regardless of cause.

6.3 Medical Authorization: In the event of an emergency, I authorize Key2MIA® to arrange necessary medical treatment at my expense.

6.4 Alcohol Consumption: I acknowledge that I am solely responsible for my behavior and safety while consuming alcohol during the tour.

6.5 Indemnification: I agree to indemnify and hold harmless Key2MIA® and its staff from any claims, damages, or expenses arising from my participation, including attorney’s fees.

6.6 Promotional Use: I grant Key2MIA® a royalty-free license to use any photographic, video, or digital likeness of me captured during the tour for promotional, educational, or commercial purposes.

6.7 Binding Agreement: This Waiver and Release of Liability is binding upon my heirs, next of kin, executors, administrators, and successors.

7. Intellectual property

7.1 All content provided during the tour, including but not limited to historical information, itineraries, and materials, is the intellectual property of Key2MIA® and may not be reproduced or distributed without written permission.

8. Governing law

8.1 These Terms and Conditions are governed by the laws of the State of Florida.

9. Agreement to terms

By reserving, purchasing, or participating in a tour, you affirm that you have read, understood, and agree to these Terms and Conditions, including the Waiver and Release of Liability.
